Our office represents one of the largest Israeli entrepreneurial companies in their field in the real estate industry in their activities in Eastern Europe. The representation includes handling aspects of real estate taxation, including the establishment and management of legal structures for the use of international treaties to prevent double taxation, management of all legal phases of the project (with the assistance of local law firms). , starting with the purchase of the land, engagements with contractors, handling the financing aspects of the projects, handling various regulatory issues, and participating in board meetings as legal advisors.
As part of the representation of international corporations in initiatives in Eastern Europe, it became clear that the financing system in these countries does not provide an adequate response to complex projects. In cooperation with the legal department of a local bank, our office drafted the first financial support agreement in Eastern Europe that allowed entrepreneurs in the field of residential real estate to use both the bank's funds and the funds of the buyers to promote the project. The innovative financial support method that was developed was very successful, and the wording of the agreement was copied for many projects in Poland and in Romania, while collecting copyright royalties for our office.
Representing non-residents before the tax authority and establishing a precedent according to which non-residents are entitled to a tax distribution, despite an explicit provision to the contrary in the real estate taxation law. The precedent was reached without the need to go to the courts, using express clauses in the Convention for the Prevention of Double Taxation that prohibit the deprivation of foreign residents in relation to Israeli residents.
As part of the legal management of a long-standing family dispute, a receivership order was issued for the assets of an airline company. Our office managed the collection case and acted in accordance with the court's instructions for the sale of the company's assets on a significant scale.
The firm represented for years one of the largest banks in the country. In this framework, the office acted on behalf of the bank for the realization of securities, asset seizures, financial claims and even participated in the preparation of part of the bank's managers in light of rulings and regulation on the subject.
